A lawsuit was brought against Defendants Plasco Manufacturing Ltd., Thermal Ease Hydronic Systems, Inc. (“Thermal Ease”), and Hot Water Systems North America, Inc. The lawsuit claims Defendants manufactured, advertised, distributed, and sold UltraPEX Tubing that will prematurely rupture and fail. Defendants have agreed to the Settlement to avoid the uncertainty and expense of additional litigation, but dispute all allegations of liability or wrongdoing.
